Record-keeping duty under the Minimum Wage Act

Hospitality is one of the industries with special duties: start, end and duration of working hours must be recorded promptly.

Shifts and split shifts

Lunch and evening shift with breaks in between: every punch is recorded, breaks are clocked or entered as a total.

Lots of temps

New temp? Added in a minute, PIN assigned, done. Whoever leaves gets deactivated – the data is kept.

Do I have to record my employees' working hours?

Yes, employers in Germany must record working time. For mini-jobs and some sectors there are especially strict rules.

Duty for all employers

In 2022 the Federal Labour Court ruled (1 ABR 22/21): employers must introduce a system that records the start and end of daily working time.

Mini-jobs and certain sectors

For mini-jobbers and sectors such as hospitality, construction, cleaning or hairdressing and cosmetics, the Minimum Wage Act requires: record start, end and duration of working time within seven calendar days and keep the records for at least two years.

Customs carries out checks

The customs unit for undeclared work checks these records. If they are missing, wrong or late, fines of up to 50,000 euros are possible (section 21 MiLoG).

With Zeittel these records are created automatically as soon as your employees clock in – traceable and exportable at any time.

If the device has no access to the App Store or Google Play – a PC or a very old tablet, say – you use the web time clock in the browser; current browsers are Chrome, Edge and Firefox from version 111 and Safari from iOS/iPadOS 16.4.
